Before Ordering

Please view my Commission Form to determine what you are ordering is available and be sure to review my legal Terms of Service statement before submitting an order. If you are trying to contact me to ask a question, please review my FAQs to ensure that your question hasn’t already been answered.

How to Order

If it is available in your country of residence, I highly recommend submitting your order through Artistree- it handles payment and information in a streamlined way that ensures both buyer & seller protection.

If you prefer to reach out to me directly, you can send an e-mail to [email protected] at any time for inquiries related to my commissions, including pricing, processing, availability, etc.If you’re submitting an order manually, please follow the E-mail Form outline I have provided. It makes it much easier to communicate your needs to me, and for me to keep your order organized on the back end.

Keep in mind that I have a limited number of slots that I open each round of commissions, so if your order total exceeds that, I may have to decline your request. You can view my Current Queue at any time to view my activity and availability.

Commission Pricing

I have a scaled pricing model depending on the approximate amount of time spent on each commission type. Pricing begins at $25 and usually do not exceed $100-200 range.

Content & Subject Material

I am an anime/kemono artist first and foremost, my work will resemble the style as shown in the examples below- I do not work with "other styles." Although I am relatively flexible, there are a few subjects I do not feel confident in offering to my commissioners, therefore I highly recommend finding another artist if you have needs that fall outside of my own capabilities.

I do not accept requests that include the following:
Photo-realism, Photo-manip/edits, GFX/Graphic design, Logo/Tattoo design, Video/Animation, Graphic Violence, Ideologically sensitive/hateful, Stolen/"heavily referenced", Generative AI, Live-stream/screen-share, Time constraints/deadlines

Section I. Payment & Processing

• Payment is required up front & in-full. I do not accept payment plans/IOU or exchange for goods/services.• All prices are listed in US Dollar ($) amount. Exchange rates, taxes, & fees may be applied.• All commissions are done in the order they are submitted & processed within a 30-day time period. Wait times are usually 1-3 business days, or up to 7-days for very large orders, once your slot is reached.• I generally do not work with time constraints, as a general rule of thumb if you need something before a certain date it is recommended that you order 30-days prior to your anticipated due date. If you need a rush delivery it must be discussed before payment. Fees may be applied (no sooner than 48-hr delivery).• Once payment is processed, I do not allow changes to the order. Please double-check that all your information correct before you send payment, as I will only correct errors that are made on my behalf.• All sales are considered final. Refunds are only available if there is failure to deliver your order within the 30-day time period from initial payment date. Fraud will be reported as such.

Section II. Artist Rights

• I have the right to decline or turn away clients for any reason.• I am under no obligation to actively communicate with my clients about subjects unrelated to their commission.• My artwork is never to be used commercially without my full, prior consent. Social media profile use for small business is OK, however if you are planning to print/reproduce my work in any way (real or digital) it must be discussed beforehand.• I do not waiver any rights to my artwork unless signed agreement under contract; if I feel my work is being exploited I have the right to protect my work as I see fit.

Section III. Buyer Rights

• Your commission may be uploaded to personal page, gallery, social media, etc. as long as proper credit is attributed. ("Faye M." or "Faye Mercury")• Link back to my website (www.fayem.art) or applicable social handle (@fayem / @FayeMercury / @mercurialfaye) is appreciated.• I allow modifications and remixes, by or on behalf of the rightful owner of any commission, as long as it is done under fair use. I do NOT allow the use of generative AI to be used on my works under any circumstances.• I do not allow my artwork to be resold, reproduced, or redistributed, with the only exception being character resale markets. If this applies to you, read the section below.

Section IV. Custom Character Designs

• When a transaction is made, either by commission or adoption sale, I am not forfeiting legal ownership of my work, nor am I contractually signing over copyrights. Understand that when you pay for a character, you are paying for the right to use the art & design, not for legal ownership of the art & design itself.• It is my personal commitment to the buyer to uphold this in a fair way, however I maintain the right to protect and use my work as I see fit. I will only act in self-defense to protect my work in egregious cases of misuse or blatant disregard of my TOS.• As with all of my work, I do not allow commercial use/re-distribution or re-production of my artwork/designs without my prior consent. There is one exception as it relates to custom character designs, stated below.• You may include my artwork of your OC in a one-time OC sale, as long as it is done so legitimately and you do not falsely inflate the value, i.e. "flip" the design. You do not have to ask, I do not track character designs, it is understood that this is a trust system between artist & customer at the time of payment.• I cannot anticipate or enforce third-party involvements, such as character re-sale or ownership disputes. Please instead take it up on the platform where the sale occurred. I act ONLY when it is necessary to protect my work, and I will not become involved with personal disputes.

Section V. Regarding AI

My art is 100% created by hand without any use or assistance from AI, in Procreate for Apple iPad using Apple Pencil, aside from Krita occasionally for strictly formatting purposes. Both Procreate and Krita are explicit about the fact that they do not include AI in their software.Due to fraudulent cases, from here on, if you for some reason you have the false notion that I use AI, then you are accepting responsibility for working with me, even if you are under the false impression that I use AI, and I am not responsible for your undue suspicion or buyer's remorse.

Section VI. Conclusion

You are paying for my TIME and my SERVICE, as presented on my page. Your product's results will be a combination of YOUR DESCRIPTION & REFERENCES, and will reflect the EXAMPLES SHOWN ON MY PAGE. If you are not okay with that, DO NOT WORK WITH ME.I am very understanding and want my clients to be happy with the end result. I can usually provide 1-2 small fixes for no additional cost, but communication goes both ways. Q: What tools do you use to create your work?
A: All of my newer works are made using iPad 7 & Apple Pencil + Procreate. Some older pieces may have been done with PaintTool SAI + Wacom Intuos tablet. I am not a traditional artist, but I do occasionally enjoy coloured pencils, alcohol markers, & watercolours.

Q: How long does it take you for one piece of artwork?
A: It can take me 30 minutes or multiple hours depending on the scale and quality of the work; total work times are reflected in the final price. If you are currently waiting on a commission, you can check the status on this board. Usually it takes 1-3 business days to complete a commission once it is started, depending on how full my queue is.

Q: Can you create something for me based on this photo?
A: It depends. I do not work with photo-realism so I am not the artist for you if you are looking for someone to create a painting based on your photo. However, I am happy to draw a cute cartoon version of you or your pet using a provided photo, just please be aware there is limitations.

Q: Will you design a logo/tattoo for me?
A: No, sorry but I am not confident in my graphic design skill in a way where I would want to do a logo/tattoo design for money.

Q: Will you design merch for my brand?
A: We can talk about it, but I will require details about your brand. I am not a graphic designer by trade, so there is a chance I may not be able to fulfill your request.

Q: I bought character artwork from you, can I re-sell it to include in a one-time character sale?
A: Yes. You may include my artwork to re-sell if you are bundling a character together in a one-time character sale, as long as you do not falsely inflate the price, re-produce, or redistribute my work. I do NOT keep track of character permissions, and you do not have to ask me. Character markets are a trust system and failure to abide will result in warning, and in some extreme cases blacklisting and/or re-purposing of my art/designs.

Adoptables

"Adoptables" is a term that means you are essentially paying for the right to use a unique, individual pre-existing character design, and all of the art associated with it. They are one-time sales that may be used for art, writing, roleplay, and so on. All adoptables fall under my Character Design TOS, which is designed to protect the artist, while still allowing freedom and leniency to the buyer.

Character Bases

"Bases" are basically linearts that anyone may purchase serve as a blank slate for someone to create their own design onto to be used for art, writing, roleplay, etc. Designs made on these bases are considered third-party and do not fall under my character TOS, but some Terms still apply to protect my work. Please be sure to read each listing carefully before continuing with your purchase.

Your Character Here

"Your character here" (also called "YCH" for short) are a piece of artwork that is created by the artist, based on a pre-exising example, usually a sketch or a base, but with intention to complete the drawing with custom detail per the buyer's description upon delivery. They are cheaper to produce than commissions, and some may even be unique.

Section I. General Statement

• My "Shop" on this website just serves as a directory and is not updated automatically, therefore actual listings associated with products shown here may actually be sold out.
• All digital download sales are hosted via Ko-fi which handles payment & delivery securely. Any payment processing issues should be taken up with them.
• PayPal may be provided directly via E-mail upon request, but I will not put something "on hold" to secure your desired product.
• No shipping information/fees are required for digital downloads, as you are not receiving a physical item.
• I only accept cash exchange, do not contact with unsolicited offers (trades, services, goods, giftcards, etc.).
• All sales are final, as each product is delivered automatically. No refunds will be issued unless there is a human error on my end.
• Once your order is confirmed, you should automatically receive your product delivered to the E-mail address associated with the purchase within 24-hours (unless it is a custom order).

Section II. Adoptables

• All adoptables qualify as a "Custom Character Design," as covered in my TOS statement.
• You may NOT use an adoptable for commercial use without my prior consent.
• You may NOT reproduce or redistribute the base lineart, designs, or any artwork associated with a design.
• You MAY modify or customize a design to your liking, as long as the integrity/accreditation of my work is preserved.
• You MAY re-sell "ownership" of your adoptable, if done so fairly & legitimately (again, refer to my TOS for details).
• I will NOT become involved in third-party disputes, everything that occurs after sale is buyer responsibility.

Section III. Bases

• Bases are NOT unique sales, others may also purchase them to use.
• My bases are for intended for personal use ONLY, and may not be used in any final promotional material.
• Bases MAY be modified to buyer's liking, as long as my watermark remains visible/legible somewhere on the canvas.
• You MAY sell adoptable designs on my bases (No minimum, maximum of $100 USD per design).
• DO NOT reproduce or redistribute the base lineart itself, or any .PSDs associated with it.
• I will NOT become involved in third-party disputes, everything that occurs after sale is buyer responsibility.

Section IV. YCH

• All YCH are taken as a commission slot, and will require a wait-time to complete your delivery (up to 30-days).
• YCH are NOT INHERENTLY unique sales, unless otherwise specified. The artist may re-use them for additional sale.
• YCH are only half-custom, so what you see is what you get. Please be reasonable in your expectation.
• The final WILL resemble the initial concept, in species and form. A bird cannot become a horse, for example.
• Any rendered examples shown are other customer orders, unless you were the one who purchased it you do not have the right to use their version.

Section V. Re-delivery

• Upon receiving your digital order, it is the buyer's responsibility to manage any provided attachments and store them securely.
• There is a 90-day grace period from time of your digital purchase, after that time period I can no longer help you with your digital transaction.
• In case of a failed delivery, please be prepared to provide some basic information about your purchase so that I can verify the transaction.If you have any inquiries related to your purchase, please contact me by e-mail at [email protected] or use my contact form to reach out to me.

Adult-Rated Content

Pricing for my adult-rated commissions are no different than my usual pricing, although they may run you more as they often include multiple characters. By requesting an Adult-rated commission you affirm that you are legally 18+ years of age and no younger!
